Consideration and action on Resolution No. 09-149, a Resolution of the Mayor and Council of the City of Surprise, Arizona, declaring its intention to create a lighting improvement district pursuant to A.R.S. § 48-616 for the purpose of purchasing facilities and energy for lighting the public streets and parks for the Quik Trip #410 Lighting Improvement District.

| I move to approve Resolution No 09-149. |
| Background: |
|
The City has verified that the Petition for the proposed street light improvement district contains the signatures of a all of the real property owners in the district, exclusive of mortagees and other lien holders. The City and Arizona Public Service Company (“APS”) have approved the street layout and facilities design. The electric rates are established by APS tariff. The lighting improvements are more than local or ordinary public benefit and the expenses of the district will be paid for by the levy and collection of ad valorem taxes upon the assessed valuation.

Any financial impact on the City is anticipated to be minimal, as the Developer and District will be bearing the costs and expenses of the District and street light improvement facilities.
