Consideration and action on Resolution No. 09-154, a Resolution of the Mayor and Council of the City of Surprise, Arizona, declaring its intention to create a lighting improvement district pursuant to A.R.S. § 48-616 for the purpose of purchasing facilities and energy for lighting the public streets and parks for the Westfield Commons Lighting Improvement District.

| I move to approve Resolution No.09-154 |
| Background: |
The city has verified that the petition for the proposed street light improvement district contains the signatures of a majority of the real property owners in the district, exclusive of mortgagees and other lien holders. The city and Arizona Public Service Company (“APS”) have approved the street layout and facilities design. The electric rates are established by APS tariff. The lighting improvements are more than local or ordinary public benefit and the expenses of the district will be paid for by the levy and collection of ad valorem taxes upon the assessed valuation within the district.
Following adoption of Resolution 09-154 it will be posted and published, as required by Arizona law. Any protests or objections to formation of the proposed district may be filed within 15 days thereafter, and a public hearing to consider the same will be held. If no protests or objections are received, the city shall adopt a resolution ordering the work to proceed.

Any financial impact on the city is anticipated to be minimal, as the developer and district will be bearing the costs and expenses of the district and street light improvement facilities.
